CA Scrap Tire Bills Advance
Despite, a major report on California's scrap tire situation due
to be presented to the legislature next month, four bills were
introduced in February. The bills seek to improve the state's
existing programs for scrap tire abatement and recycling. Three
were passed by policy committees during the first week of April
. The fourth, AB 1055 (Villaraigosa) would provide grants for
making playgrounds which use recycled rubber materials safe was
referred to the Assembly Natural Resources Committee.
The following
bills advanced:
SB 827
(Sher, D-Palo Alto) is designed to encourage the use of asphalt
rubber in state highway construction projects by requiring the
State Procurement Officer to purchase recycled materials for use
in pavements unless the Department of Transportation "determines
that the use of the materials is not cost effective." A new
definition of "cost effectiveness" includes lifespan, durability
and maintenance cost for pavements containing recycled materials.
The bill has no opposition and will next be heard in the Senate
Environmental Quality Committee.
SB876
(Escutia, D-Bell) would redefine the term "waste tire" to
include a repairable tire, a scrap tire, and an altered tire but
not a "used tire or granulated rubber." The bill moves on
to the Senate Appropriations Committee.
SB1055
(Bowden, D-Marina del Ray) would allow CIWMB access to private
property containing illegal tire stockpiles to remediate or stabilize
the tires. The bill requires CIWMB to find that the property is
a "significant threat to public health or the environment"
and obtain an order setting liability from a court.
